Kopaxy is a website platform operated by Octopus Team Pty Ltd (Australia), trading as Kopaxy and No Ads Agency.

By accessing or using any Kopaxy-powered website or service, you agree to these Terms.

1. Who This Policy Applies To

By accessing or using any Kopaxy-powered website or service, you agree to these Terms.

  • Business owners activating or using websites provided through Kopaxy

  • Visitors using the Kopaxy platform website (kopaxy.com)

  • Individuals submitting enquiries through websites powered by Kopaxy

If you do not agree with these Terms, you should not use the service.

2. The Kopaxy Platform

Kopaxy provides:

  • Prebuilt website templates for local service businesses

  • Website hosting and maintenance services

  • Optional automation tools, including enquiry handling and AI-powered systems

Kopaxy does not provide trade, professional, electrical, or emergency services.

3. Website Activation & Subscriptions

Some Kopaxy services require activation and payment.

When you activate a website or service:

  • You agree to the applicable subscription fees

  • Fees are billed on a recurring basis unless cancelled

  • Subscriptions are month-to-month unless otherwise stated

You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period.

4. Payments & Billing

Payments are processed through third-party payment providers.

Kopaxy and No Ads Agency:

  • Do not store payment card details

  • Are not responsible for payment processing errors caused by third-party providers

You are responsible for ensuring billing details remain accurate and up to date.

5. Acceptable Use

You agree not to:

  • Use the platform for unlawful purposes

  • Submit false, misleading, or abusive content

  • Attempt to interfere with platform security or functionality

  • Use Kopaxy services to provide emergency, hazardous, or time-critical instructions

We reserve the right to suspend or terminate access if these Terms are violated.

6. Automated & AI Services

Kopaxy may use automated and AI-powered systems to:

  • Respond to enquiries

  • Handle inbound calls or messages

  • Send confirmations and follow-ups

These systems operate automatically and may make decisions without human review.

You acknowledge that:

  • AI systems may not always be accurate

  • AI responses should not be relied upon for urgent or safety-critical matters

  • Kopaxy does not guarantee specific outcomes from automation tools

7. SMS Communication

Kopaxy and participating businesses using the Kopaxy platform may send SMS messages related to customer enquiries and service communications.

Message frequency varies depending on customer interaction and is typically limited to responses related to a specific enquiry.

Message and data rates may apply.

You can cancel the SMS service at any time by replying STOP to any message. After you send STOP, you will receive a confirmation message and no further SMS messages will be sent unless you initiate contact again.

If you need assistance, reply HELP for support.

Carriers are not liable for delayed or undelivered messages.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. SMS opt-in data and consent will not be shared with third parties.

8. Content & Information Accuracy

Websites created through Kopaxy may use:

  • Information provided by the business owner or representative of the business

  • Publicly available business information

You are responsible for reviewing and confirming the accuracy of your website content after activation.

Kopaxy is not responsible for inaccuracies caused by incorrect or outdated information supplied by third parties or business owners.

9. Intellectual Property

All platform software, templates, branding, and underlying systems remain the property of Octopus Team Pty Ltd (trading as Kopaxy and No Ads Agency).

You may use your activated website for your business while your subscription remains active.

You may not:

  • Resell or redistribute Kopaxy templates

  • Reverse-engineer or copy platform functionality

10. Service Availability

We aim to provide reliable service but do not guarantee uninterrupted availability.

Kopaxy may be temporarily unavailable due to:

  • Maintenance

  • Updates

  • Third-party service interruptions

We are not liable for downtime beyond our reasonable control.

11. Limitation of Liability

To the fullest extent permitted by law:

  • Octopus Team Pty Ltd (trading as Kopaxy and No Ads Agency) is not liable for indirect or consequential losses

  • We do not guarantee increased enquiries, revenue, or business outcomes

  • Use of the platform is at your own risk

Nothing in these Terms excludes liability that cannot be excluded under Australian law.

12. Termination

We may suspend or terminate access if:

  • These Terms are breached

  • Required payments are not made

  • Use of the service creates legal or operational risk

Termination does not affect any accrued rights or obligations.

13. Privacy

Your use of Kopaxy is also governed by our Privacy Policy, which explains how personal information is collected and used.

14. Changes to These Terms

We may update these Terms from time to time.

Material changes will be:

  • Emailed to active subscribers

Continued use of the service after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
